InsightPulse Terms and Conditions of Use





I. For purposes of this agreement, InsightPulse and InsightPulse.com may be used interchangeably.

II. InsightPulse.com provides space for hosting surveys, but makes no implied or express warranties about the reliability of this space or related services. InsightPulse.com is not responsible for any deletion, alteration, or loss of data, survey, or results due to network or system outages, file corruption, accidental deletion, incompatibilities or any other reasons. InsightPulse.com makes no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such.

a. Users are responsible for regularly monitoring and creating backups of their own files, and agree to use the InsightPulse.com resources and infrastructure at their own risk. This service is provided on an "as is" basis without warranties of any kind, either expressed or implied. Neither InsightPulse.com nor its partners makes any warranty with respect to any content, information, services, or products provided through or in conjunction with this service.

b. InsightPulse.com and its partners make no guarantee of the accuracy, correctness, or completeness of any information on these web pages, surveys, databases, or results and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained on our servers; or losses or damages arising from the use of the content or services provided by InsightPulse.com.

c. InsightPulse.com and its parent company reserves the right to include traffic generated by all web sites it hosts in its overall accounting of page views, unique users, and other usage measures. This includes providing web traffic measurement companies with all URLs hosted by InsightPulse.com for use in their projection of InsightPulse.com and the parent company's overall traffic.

d. Users agree to indemnify InsightPulse.com and its partners against any and all claims and expenses, including attorneys' fees, arising from their use of this service. This expressly includes their responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and any libelous or unlawful material contained within their survey.

III. InsightPulse.com may terminate user accounts at any time without notice for conduct that violates these terms and condtions of use, or for any other reason, and may terminate user accounts and delete any and all user information for conduct that InsightPulse.com believes is harmful to the InsightPulse.com business, or any of its users or partners. The following is a non-exclusive list of content and behaviors that are UNACCEPTABLE to InsightPulse.com:

a. Content that contains: pornography, adult content, sex, swearing, abusive or foul language.

b. Content that condones, promotes, or contains, warez, cracks, hacks, their associated utilities, or other piracy related information, whether for educational purposes or not.

c. Surveys that are promoted through the sending of unsolicited email (spamming) or mail fraud schemes, or surveys that promote or condone the sending of unsolicited email to individuals not affiliated with the sender. Users of InsightPulse.com resources are subject to prosecution to the fullest extent of the law.

d. Surveys that commit acts of copyright, trademark, patent, trade secret or other intellectual property infringement.

e. Content that is racist, or otherwise extremely offensive to others, including content which aggravates, harasses, threatens, defames or abuses others.

IV. InsightPulse.com provides the service of hosting online forms and surveys and does not provide e-mail services. Any surveys received that carry the InsightPulse.com logo were developed using our services, but were not sent by InsightPulse.com. Rather, they are sent by the party building the survey using their own e-mail service provider.

V. Users grant InsightPulse.com unconditional permission to use all findings on an aggregate basis for benchmarking purposes. Data used for benchmarking will not identify any individual respondent or company participating in any InsightPulse study.

VI. Other InsightPulse.com rules and guidelines:

a. Each user is responsible for building and updating his/her survey, and regularly backing up any related data once survey is closed.

b. User accounts may be deleted after 60 days if there is no activity on the account, in order to free up unutilized resources.

c. Each user is requested to take only one account. Multiple accounts may be not be created.

VII. Refund Policy.

Insightlink Communications will fully refund charges in the event that a user is dissatisfied with the execution of a survey or experiences technical problems deploying a survey. Insightlink Communications will not issue refunds based solely on dissatisfaction with the content of a survey or the resulting data.

To claim a refund, you must notify us of your refund request in writing within 30 days of the completion of the survey in question. You must include in your request a description of the problems encountered and how they negatively affected the outcome of your survey along with any supporting documentation or system error messages.

Requests for refunds must also include your name, company name, survey name and level, the method of payment, payment date and transaction/order confirmation number if paid by credit card.
